Terms and Conditions

It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

Trading Name

Kevin Rook Photography is a trading name of KCR Trading Ltd

Booking Fee

A booking fee of 25% secures the date, time and services of Kevin Rook Photography for the agreed date. The client is entitled to a full refund of the booking fee if they cancel within 14 days of booking. The booking fee will be forfeited on cancellations made after 14 days. Cancellation made within 12 weeks of wedding will result in payment in full. All cancellations must be in writing. Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time.

Balance of Payment

The balance of payment is due 21 days prior to the wedding date. . None payment may result in the photographer not attending. No photographs or wedding albums will be delivered until all payments due have been paid in full. Payment for additional images is to be made when they are ordered.

Coverage

For bookings involving a church ceremony or at certain other venues, photographers' movements are sometimes restricted by the minister or official in charge: photographing of parts or even all of the ceremony may be restricted or prohibited, as may the use of artificial lighting. The photographers cannot accept responsibility for limited coverage in such cases. Whilst the photographers shall endeavour to fulfil all the Clients' requirements, they cannot be held responsible for non-availability of subjects or adverse conditions which may delay the progress of proceedings, preventing the coverage of certain specified shots. Any alterations made to the booking by the Clients once details have been confirmed may only be made at the discretion of the photographers. If unable to accommodate alternative arrangements (such as the change of ceremony date or venue) the photographers are not liable to compensate the client(s) in any way whatsoever.

Display

Kevin Rook Photography may use any images included in this contract in their studio, web site, portfolio, literature, display areas, exhibitions, competitions, advertising, slide shows or commercially.

Images

All image sizes are nominal. The Photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibers. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.

Retouching

Retouching, digital manipulation and artist finishing is available to the Client as an optional extra.

Reorders

All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.

Copyright

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988 and remain the copyright of Kevin Rook Photography. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the written permission of Kevin Rook Photography.

License

Kevin Rook Photography shall be granted artistic license in relation to the poses photographed and the locations used. The Photographers judgment regarding the locations, poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.

Force majeure or Act of God

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

Attendance

In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances Kevin Rook Photography reserves the right and will endeavour to appoint other photographers to attend your wedding on its behalf to undertake your wedding to the best it ability. However it may prove difficult or impossible to find a skilled replacement photographer at short notice or at the same price.,

Limitation of Liability

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

Cancellation

The Client may cancel this contract at any time by giving written notice to Kevin Rook Photography but in doing so shall forfeit any monies paid if cancellation is made after 14 days of booking. Cancellation less than 12 weeks before the wedding date will result in the payment in full.

Negatives / Digital Files

Negatives / digital files remain the sole property of Kevin Rook Photography.

Durability

All the photographs I supply are produced to the highest standards using the best quality materials and latest processing techniques. However, all colour photographs will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass. I cannot accept any responsibility for this gradual image deterioration.

Your Wedding Album

I will choose images to display in your album. Good practice is to have between 5 and 6 images for each, but not every, double page spread. You will have the opportunity to suggest changes to the selection and/or layout. I will discuss your ideas with you and let you know whether they can be incorporated. The first set of changes will always be made completely free of charge.

I may need to make a charge for any changes requested subsequent the first edit. I will always give you prior notice of any charges and work will not proceed without your agreement.

Returns

Pictures and albums are presumed to have been received in good condition unless I am notified in writing of any discrepancy or error within 14 days of receipt. For orders that need to be returned please send to the address above with a letter containing all order details and the reason for returning the items. If a refund request is acceptable it will in any case be subject to an administration fee.

Prices

All prices are subject to the then current rate of V.A.T. (if applicable).

Gift Certificates

Kevin Rook Photography Gift Certificates are valid for 18 months from the date of purchase. Please note that Kevin Rook Photography Gift Certificates cannot be exchanged for cash, are not transferrable and are not negotiable.

Payments

Payments made by cheque should be made payable to KCR Trading Ltd or via Paypal at Kevin.rook@KCRTradingLtd.com. Alternatively Bank Transfer (BACS) payments can be accepted by arrangement.
